I think he's allowed to stay. As long as he isn't living there a few nights a month is hardly an issue.
I would be VERY careful because it isn't uncommon for people who you believe are your 'friends' to tell centrelink that you and your ex have 'reunited' and whole investigation process sucks..
He can stay up to two nights a week is my understanding.
