My daughter was sexually touched
Statements have been given.
Arrest was made.
We are coming close to the trial, but she has said she won't give evidence.
What happens if she won't on the day.
Is that it its all over with and he walks?
As its sexual touching it stays in the local court.

It may be thrown out then
We went through this a few years ago with my step daughter.
She was questioned by detectives which was video taped, as well as her lawyer and then She was then interviewed by his lawyer. These videos were played at the trial. She never saw the videos and was not present in the court room. I found the the videos very confronting and heartbreaking. But she was very brave and strong in her answers. He was found guilty of 3 counts of indecent dealing with a minor under 12 and 3 counts of indecent penertration with a minor under 12.
My partner has worked on many child abuse cases. (it really depends on the individual case but) He said that if it is reliant on her statement, the DPP may withdraw the case. She may also give her statement prior on video. If the case isn't relying on her and there is enough evidence present, she may not be needed at all.
It all depends on her individual case. It's best to speak with your representative and/or detective.
