Custody

Custody

Ex partner ( not biological parent) threatening custody of my kids.

I seperated from my ex over a year ago and my ex did not want any contact with them. I strongly encouraged contact which was sporatic - with her often choosing one child over the other.

There’s been no contact with my three kids 10,7,6 for 4 months however is now threatening to take me to court for custody.

Is that even possible ?

Is this a same sex relationship and the kids were fathered by a donor or did she come into the picture later? I think it sounds more complicated than what you're saying here. If she has been a parent from the start I think you should do the right thing, start with mediation and get some ground rules in place so she can't just come and go as she pleases.

If it's a same sex relationship she has the same rights as you and yes she can take you to court for custody.

It depends.

Full custody, nope. Nobody gets full custody except in cases of extreme abuse but even then it’s hard to get.

When did you both start your relationship? How old were the kids. Is she on any of the kids birth certificates as the other parent?

Has she attempted mediation?

The no contact for 4 months wont count for anything if she has rights to the kids. Is there any reason she would have rights to the kids? Why did you encourage it?
