hi I’m looking for help on how to declare my self bankrupt I’m not sure how to do it it’s for just over $5000 I’ve been assumed a debt. i ordered a product from a company and within the cooling off period i canceled it but they sent the product the same day the item wasn’t installed i called to get someone to come pick it up, it took the company 7 weeks to come get it. the person who picked it up said no i don’t need to sign anything they will scan the barcode and that is like a signature after that i didn’t hear anything else about.

until today i got an email saying there’s been a unsatisfied judgment made against me I’ve emailed the company legal force who emailed me saying the debt isn’t mine and it isn’t my fault the product has been lost in transition or hasn’t been logged correctly that it was picked up so i guess it’s my word against theirs

I’m a single parent i have no car no assets etc they’ve sent me a attached form to fill out with how much centrelink i get what assets i have what money i have etc and well i don’t have any of that and I’ve explained that in the email

i feel i have no other option but to declare my self bankrupt I’m not sure what to do

Contact legal aid in your area before you do anything. You need legal advice.

Noooo dont declare bankrupt! Let them chase you and its on them to take you to court and lets face it youre in the best possible position right now IF you lose - they cant take anything if you have nothing. They set up a debit for what you can afford, you show how you can only afford$5 a fortnight, or none, and thats what you pay.

I would also recommend contacting your states consumer protection agency for advice. The website for each states contact details is https://www.accc.gov.au/contact-us/other-helpful-agencies/consumer-prote.... I’ve approached them before and they were incredibly helpful in detailing my rights as a buyer. The company I was dealing with also changed their tune pretty quickly when I provided them the information they had given me

Do not go bankrupt. I'm unsure why you ordered something, if you couldn't afford it. Sounds like you shouldn't have the debt. So refuse to pay and get legal advice.

Fight it. I had this happen $2000 product except it didn't work in area like they claimed it would. I sent back within cooling off. Apparently didn't get sent back in time. I didn't claim it didnt work, just that Id changed mind.

do not go bankrupt, life long problems, get legal aid to work through this, and then contact fair trade. you should have been able to at least represent yourself if there was a case against you.
