Custody - same sex relationship

I have a friend who is in a same sex relationship and they’ve been together for over 7 years and they started a family a few years ago. Beautiful baby girl, they went through an IVF clinic and it was done professionally, they had counselling, chose the donor, both Mums are listed on the birth certificate etc. Now as this little girl has grown, she has two amazing mothers and they parent equally and both love this child with all of their being.

Their relationship has since become more of a friendship and they have decided mutually that they will seperate, but biological Mum is assuming that little girl will live 100% with her because she birthed her.... And other mum may visit. This doesn’t sound right, at all, my friend is absolutely devastated at this thought. Has anyone been through this?, I’m assuming courts will work the same way as a heterosexual relationship, where does my friend stand? How does she get things legally drawn up for custody?

It’s all the same processes.
Your friend should initiate mediation ASAP. She should also get some legal advice. She should be able to ring a free legal advice hotline to get the information she needs.
Your friend should then let the other parent know (nicely) that she has received legal advice, she knows her rights and she wants this all to be done nicely out of the court system.
What ever she does she shouldn’t threaten to take her to court (at this point) because that’s when things get out of hand, and she wants to do it the nice way!

Thank you for your replyI thought it would be the same. They are still living together (thanks to this virus) but obviously are talking etc. I have told her to perhaps shelf it for a little while so nobody needs to get upset with everything else. And she definitely wants to do it the nice way, for their daughters sake if nothing else 💓
