Okay, so We are looking at taking our 4 kids on an overseas holiday in about 12 months. The only things is I don’t have passports for my oldest two kids (7+5). I have no idea where their biological father is or any of his family. The only person who would or could have told me how to contact him was his mother, but she passed away. I don’t really want to track him down as he is a very dangerous meth addict and is in and out of prison. He hasn’t seen or spoken to the girls in 4 years (his choice). Is there anyway I can go about getting a passport with out his signature?

Yes, it's a tough road and generally ends up in court. Start the process immediately.

You take the situation to court hun , not him . The judge will override his need to be there and grant you the rights to the passports without the fathers input . I have been in this situation myself . You just have to explain to the judge what you just told us on your post .
I can vaguely remember my Mum signing a stat dec saying she had looked and couldn’t find him and hadn’t had contact with him for x amount of years for my passport as a kid. She got it no dramas. I’d call and ask.
This can be a lengthy process as it is a legal requirement that both parents agree to the children leaving the country. It is deffinently possible though.
You get a B9 -special circumstances form from the government passports websites. This form allows you to explain why you can't get the father to sign. If he has previously applied for a passport they will send paperwork to the address provided with his application.
The only time it will end up in court is if a parent declines and the other parent wants to take it further.
