After a painful separation I have been considering moving back to my home town in another state. I have a one year old who is my ex partners and he is not a competent father. How would I go about being able to get custody of her and moving away.
He's not abusive just uninterested in parenting and wants his freedom back. We are currently living under the same roof and I cannot afford to live in the state or town we live in

You have to go through all the correct channels etc such as mediation etc because the child and the father both have rights. Moving interstate may not be as easy as it sounds.
When I got legal advice I was told if I was to move interstate with out my child's fathers permission he could get a recovery order meaning the child would have to be returned, I also had a friend just go through it as the father to her child wasn't hands on she moved but stayed in the same state to be with her family for support and because it was more then four hours away she was made to return even though it ment she now has no family support
Ask him. If he agrees then you save all the hassle of going to court
I moved 2.5 hours away, my Ex tried to get a order for us to move back closer to him,thankfully the judge Allowed us to stay,if moving to another state you will need to have reasons why, good luck, I hope everything works put for you xo
