All right this is a long story, but my partners children have been basically dropped off at his parents by his ex wife. She does not want them in her care atm. Nor has she given the chance to their father to have them. Long story short she stopped contact with him for a couple of years despite his trying. Anyway he now has contact and is paying his parents child support along with visits and face timing.(lives in a different state) She's tried to stop contact with her family also, which is devastating to the kids. To add to the story his parents are trying to get a consent order signed by her so they have custody for the time being, just so we can sell our house and get a bigger one to accommodate them. I have three 50% of the time and one with him so in total there will be 6. The kids have been in his parents care for nearly 4 months and still no sign of this being done. What I was wondering is there a recovery order we can apply for? Or is it best to wait until we are prepared for them? We just don't want her to remove them from a stable situation right now as they need it. To add I'm in QLD Australia.

why would you have waited until you have a house. I would have found space immediately for my own children. This situation doesn't make sense.
If my ex dropped my kids off at my parents I would have been there in hours to pick them up.
You don't need a recovery order for your own kids where his parents don't have legal paperwork. He can just go get them!
If you have your kids in one room and his kids in another short term, what's the problem????
I'm sorry I don't get it at all!
It's the sort of thing you just make work, because those poor kids need to be with one parent.
Unless his parents are saying he can't have his own kids, the courts don't need to be involved.
