Applying for divorce

Hi Mama Jamas,

My ex husband and I have been separated for over 3 years. I told him after the first 12 months (when I could afford it!) that I wanted a divorce but he said he wouldnt sign anything because he hoped I would change my mind and we would reconcile. Uhhh, no. Now we are both re-partnered and he refuses to file because he doesn't want to pay. I know right, how annoying?

I have just been informed that if you're a healthcare card or pension card holder, you're eligible for reduced fees. Thats meeee! I did a quick search this morning online but still have absolutely no idea where to start. I not long found out im pregnant with bub #2 and my partner will be moving in in the new year after his lease ends, so I want to file while im eligible for reduced fees.

Please help! Where do I start? We were married in NSW but now I live in another state. Do I need to be in NSW to file? Do I go through Legal Aid? Can I file myself? What are the costs involved? Are there any hidden? Im scared I will see a reduced figure, but it will snowball and end up costing me money I cant afford.

You can do it from anywhere in Australia. It costs $280 to do it directly through the family law courts.
Just google Family Law Courts Australia divorce. All the info is in the site.
There are no hidden fees it's very simple.

Do it all yourself, I did, make sure it is an application submitted by just you and you get the reduced fees. As you have kids, you will have to make a court appearance, but it is fine. As above commenter said, everything is on the website. You can't give him the forms (serve him), someone else has to, I got my mum to. You will see on the website, it's very simple, I made 3 visits to the court house during the process: 1. To submit application 2. Court appearance 3. Used the free jp service to get everything certified fo free! Good luck.
