How do I go about changing my children's last names with out their "fathers" consent. He hasn't seen or contacted them in over 1 and a half years. I have another child now who has my last name and I wish for them to all share my name so my youngest doesn't feel left out and they don't feel like they are different, I never wanted them to have his last name to begin with but I was very young and he pressured me into it so they could carry on his last name. I plan on speaking to a lawyer but I want to see if anyone else had been through this before.

If you are located in Queensland you need to make an application to the Magistrates Court to change the name. It's quite simple and relatively easy. You will need to serve documents on the father so he has a chance to appear but it's all quite simple.
If you can show that it is in the best interest of the child to have your surname the courts will grant it. My child's father hasn't really been in the picture. He's been on and off for the last 5 years. He's still been there but not enough, he doesn't financially, physically, mentally or emotionally help with our child, he just walks in for play dates every once in a while.
I was granted orders to change my Childs name to my surname so best of luck Mum! I don't see why you wouldn't be granted when I was.
With no dramas you can at school add AKA (also knows as) "your last name" and at 18 they can pick. I was AKA until I could change it myself. That way day to day they can use yours
