So we have a long history (4 years since we loved in) of our neighbour being a psycho. Long story and details skipped I'm 90% sure he records us in our backyard on a daily basis. We have a 4.5yo girl. I have no proof is doing this just awareness of how psycho he is and the fact his curtains move and we often see a red light on in one of his windows when we are outside at night. What can I do? What are our legal rights?

Honestly the best thing you can do is move. These situations rarely sort themselves out and he can do whatever he likes while on his property, even if that means looking into your property. You could look at growing some trees/shrubs to screen or look at council regulations regarding fence heights. But basically you can't stop him doing anything on his property
Move. Definitely. We had the most psycho, nosey, lunatic neighbour five years ago. We didn't want to move but did because we couldn't stand being spied in every day snd gossip being spread that was completely untrue. We couldn't be happier now. It was a pain in the arse. But worth it! We now don't talk to neighbours and live on acreage. A friendly wave is the closest I'll ever get. Once bitten.........
Could you put mirrors or alfoil on your windows so all he'd be filming is a reflection?
Or get those twig/brush fencing rolls from Bunnings and attach it to your side of th fence to increase your fence height so he can't see over? My mum had a similar problem and she ended up having a trellis type thing built on her side of the fence (but not attached to the fence so the neighbour couldn't do anything about it) and she covered it in thick Shade cloth until the plants grew high enough
You can't really do anything. Even if he has a fixed camera on your house or yard. I've asked police about this, it's very hard for them to prove that it's anything sexual. People can go through civil. But that's expensive and drawn out. I would move house. I really feel for you. I would absolulety lose my shit if anyone was doing anything like this to me. Our laws need to change. Cameras and drones are so cheap now anyone can get their hands on them.
Mount an infrared light out the back (or all around the house), then his camera won't be able to see anything...
And raise the fence height...
