Mental health and AVO breach

My ex husband had bipolar and a drug addiction. He is a podiatrist. He was forcibly held in rehabs in feb and was allowed to return to work in June in accordance with regulations which required him to submit psych and drug reports.

I had an active AVO since February. I breaches him in September. His hearing was last week and it was adjourned under the mental health act. Can he really claim that he beeched his order between June and Sep when he has been clean and medicated this whole time?

He also claims he is mentally well enough for visitation. Would the courts let him claim mental illness for an AVO breach when he is working and seeks visitation?

Does anyone have a similar experience??

Perhaps get some good legal advice. I suspect he hadn't thought through that he is contradicting himself left right and centre. Make sure you get evidence of everything you can. Once he has sworn to something in court it's really hard for him to claim it isn't true but a lawyer will be able to tell yob more accurately.

I hope the law would realise how contradictory & ridiculous that is. Im surprised you can even get off with an avo breach on grounds of mental health... Contradictory in itself isnt it?? I hope you get this sorted out in your favour soon.
