Hi ladies, a bit of a complicated one here. My brother was in an accident 7 years ago and got awarded a sum of money. Its been held in funds in court as he has a brain injury. For quite some time he has been trying to do a will, but it isn't possible as he doesn't have the capacity to do so. State trustee are his appointed administrators, and he gets a wkly allowance. I'm wondering, if anything where to happen and he doesn't have a will, does the senior master release the money?

My bil is severely brain damaged. His estate is also held by the state and when he passes whats left will go to his kids. I'm unsure if there's a will or not but it would go to your dependents, next of kin anyway.
