Care arrangements for infant

Good Evening,
I’m just looking for some advice or information regarding other people’s circumstances.
Currently separating from my partner, due to DV.
Moving out of state as I have no family support where we are currently located. The problem is we have a child under 1. Wondering what kind of parenting arrangements any of you ladies have had or have, in these kind of circumstances?

You can’t just leave the state. He can make you and the child come back.

Get legal advice. You cannot just up and leave the dad 🤷‍♀️

DV against the mother means nothing when it comes to care arrangements for children. As long as dad hasn’t physically harmed the child he will be awarded either shared care of significant visitation through the courts. You also will not be able to leave the state with the child without his permission. If you do he can get a recovery order put in place making you legally obligated to return the child to the state.

-Speak to a lawyer ASAP
-was DV reported to the police?
-was the child listed on the dv order?

You technically can’t leave the state with the child, at this present time you both have equal parenting responsibilities which means he is just as entitled to be the full time carer as you are.

If you stay in the same stage then care arrangements for infants are short and frequent visits - no over nights

Unfortunately even when there is DV under family law the father still has a right to have a relationship with the child and vice versa. If you do not have his permission to relocate he can apply for a recovery order for you to return with the child. Each situation is different it’s not a straight forward answer. You need to seek legal advice.
