Can I change my sons name without the Father's consent?

My ex husband and I seperated about 2 1/2 years ago now. I've kept my married name so I can have the same name as my son.

Now my son hasn't seen his father in 2years because he left the country to go start a new life with a new family.

I'd like to go back to my maiden name but dont want to change it unless I can change my sons to. Is tgere anyway I can do this without getting his fathers consent? Because even if I could track him down I know there is no way he would sign off on it. He would make things more difficult just because of the spiteful person he is.

My son has no memory of his father and never asks about him.
When he is older and does start asking questions I'll answer them all honestly. He was only 2 when his dad left.

You can go to court to get orders that say the fathers not contactable.

Short answer is it's not easy. It involves courts and hearings.

If you are in Qld, you can apply to the Magistrates Court (NOT the family law courts) to have orders in place for change of name. It isn't very difficult, it requires you to fill out papers, file them in Court and then serve a copy upon the father (email if you have no address). There is a mention in Court and orders came be made depending upon if the father files any material to oppose. It's really not hard, go seek a lawyer for a consult and get them to point you in the right direction and then do it all yourself.
