DV breach

DV breach

I have a no contact DV order which states he can only message regarding contact or have contact if agreed apon in writing. He can only message to organise contact and not message about anything else. After a phone call which was agreed I don't speak just put it on speaker the message was saying that blah blah feels sorry for daughter that she has to have me as a mother. A little more than thisin the message but nothing to do with organising a contact. Is this classes as a beach of the Dvo? On the call he was just bad mouthing me to our child most of the time which in itself was not right. I called the police and they said they'd get someone to come take a report for the beach I read the message to the lady and she called it a breach so I'm guessing they will breach him?
Anyone know what happens with a breach? What does he get for breaching it? It's a constant battle of him doing stuff for the past two years even with an order but he hasn't been breached yet due to me not reporting it in the beginning and than I varied for no contact and he behaved somewhat but would verbally say things still. He has a pretty lengthy criminal record and another current DV order and previous orders. Will he get a decent penalty so he hopefully gets the leave me alone idea? Thanks

No advice as I haven't been in this situation before, but keep standing your ground! Record every breach,
Whether it seems big or small! There's clearly an order in place for a reason, and he needs to take it seriously. He is breaching the order, and hopefully something is done about it. Best of luck!

You sound like me. I have an AVO on my ex who can only contact through message to arrange contact, however he's breached it so many times rambling about other things. I should of breached him all of those times.
So what will happen is, your ex will be arrested by the police and taken to the station to be charged for breaching the AVO. He will be given a court date where the judge will decide on his punishment. He will most likely recieve a fine for the breach. If he continues to breach it and you continue to report it, as you should, the same thing will happen each time and he may face jail time for continuous breaches.

Even with his lengthy record DV drugs drink driving manslaughter? I just want him to leave me alone. I want it to be enough for him to realise he needs to leave me alone.
I'm so sorry your going through this! It's so tough and draining! I seriously have had enough. I should have reported so many more times before now but I'm so over it. Enough is enough. I'm sick of dealing with his crap.

Aww sweety take my advice right now, record EVERYTHING! Keep a chronological log of every conversation, every message, every incident, every moment you've felt scared or threatened. Use dates and times. Screen shot everything. Organise mediation, which will most likely be deemed inappropriate due to the DV and then it can be taken to court. Then parenting orders can be put in place to protect your children from him and you. Get him out of your life. Call legal aid for more info.

Yes, this is a breach. It's on the lower end of the severity scale, he will at minimum get a formal warning. They may send him to court, but I doubt it.

From now on, DO NOT ACCEPT PHONE CALLS. Everything in sms or email. Report EACH and EVERY time he breaches the order.

Definitely a breach. From past experience any consequences will be light, however it's important to report it each and every time. It will all be on his record and police should be cracking down on him in regards to obviously not taking the order seriously. It's a long road hon, hang in there and keep doing what's best for you and your daughter. Oh and be sure to keep any recordings for the police to hear first hand, or in case they're ever needed for family law proceedings x
