Family law advice in Vic
My son is severely disabled and doesn't want to be with his father anymore - he drags him kicking and screaming to the car and he hasn't kept court orders about weekend stays in over 7 years - he only sees the kids for 10 hours a week
Now when I told him that he doesn't want to go with him he is threatening me with lawyers
What are my rights. He has a child with his girlfriend and frankly my sons violent outbursts worries me around the baby as he has been very violent to his brothers and sisters - how is he going to be around a baby?

The process is the same wether disabled or not.
Organise mediation as your first port of call. Speak to a women's legal service for family law advice and consult a child psychologist so they can back you up.
If he hadn't been keeping your son for 'all his time' the courts won't look kindly on him asking for more time. Nor will he want more time in reality. He is just cross and doesn't know what to do. Any good lawyer will tell him he needs to go to mediation first and that it's a waist of his mine and time.
