Hey, Its been 8 months since my ex partner took our children on holidays interstate only to not return them, I have not seen my babies since that time (4yrs n 3yrs). I got multiple legal advice from everywhere over the 8 month period as much as possible and was told to wait for a mediation certificate to begin legal proceeding. I now have the certificate and am going to file my papers next week. I'm extremely distressed over the whole situation as I was told there is a chance the court will allow me visits until the children are used to me before giving them over to me as a primary carer. So my question, or more an outreach is to any mother that has gone through something similar and any advice or tips to help me for the windy path ahead. Thanks so much ladies.

Hi there, I am in no way qualified in family law, but have been through something similar (although I didn't have to wait 8 months to see my little boy).
First, I am glad you have the certificate to go through court, that's a good thing for you. From my experience the court process can take a little while, look into applying for an interim hearing or an emergency hearing, because your children are being with-held from you. If it is without your consent that should help your hearing wait time. In my situation my little boy was at risk with his Dad, so I was awarded primary carer based on his dads behaviour. I would be concerned that the father has just with-held your children, get some more assistance for your court case, legal aid or your representative should be able to use the fact that their father with-holding them from you as leverage, that he is not child focused and should be returned to their mother with 'access' to be decided by the court.
Good luck with everything. *Hugs
